Participant Waiver & Releas
COLOMBICI LIABILITY WAIVER, ASSUMPTION OF RISK, AND RELEASE
This agreement is entered into between Colombici SAS (NIT 901733291-0), Carrera 21 #101-33 Apto 601, Bogotá DC, Colombia (“Colombici”), and the undersigned participant (“Participant”).
1. ASSUMPTION OF RISK
Cycling in Colombia is rewarding. It also involves real and inherent risks. Participation in Colombici journeys includes, but is not limited to:
- Riding on open roads alongside motor vehicle traffic, pedestrians, cyclists, and animals
- Variable road surfaces including paved and unpaved terrain, gravel, potholes, and debris
- Mechanical failure of bicycles or equipment, whether personal or rental
- Weather conditions including heat, rain, wind, lightning, and cold
- Altitude-related illness including hypoxia and pulmonary edema
- Physical exertion leading to exhaustion, dehydration, cardiac events, or injury
- Travel in remote or rural areas where medical care and evacuation may be delayed
- Exposure to communicable diseases including but not limited to COVID-19 and dengue
- Acts, errors, or omissions of third-party providers of lodging, transport, and meals
The Participant knowingly and voluntarily assumes all risks associated with participation, whether known or unknown, including those arising from ordinary negligence.
2. PARTICIPANT DECLARATIONS
By signing this agreement, the Participant confirms that:
- They are at least 18 years of age. Minors may participate only with prior written approval and a signed parent or guardian release.
- They are physically and mentally fit to participate in a multi-day cycling journey at altitude.
- They have accurately completed the confidential medical disclosure provided at booking and declared all relevant medical, dietary, and safety information.
- They are an experienced road cyclist who has ridden regularly on open roads in the twelve months prior to the journey.
- Their personal equipment is safe, appropriate, and in sound mechanical condition. Participants using rental equipment confirm they have inspected it and accept it in its current condition.
- They will comply with Colombian traffic law (Ley 769/2002), all guide instructions, and the no-alcohol and no-psychoactive-substances rule while riding.
- They will wear a helmet at all times while on the bicycle.
Misrepresentation of fitness, experience, or medical condition entitles Colombici to remove the Participant from the journey without refund and releases Colombici from any related claims.
3. RELEASE OF LIABILITY
To the fullest extent permitted by Colombian law, the Participant releases and discharges Colombici SAS, its directors, employees, contractors, guides, partners, sponsors, and representatives from any and all liability, claims, or demands arising out of or related to participation in Colombici journeys, including injury, illness, property loss, or death, whether arising from ordinary negligence or otherwise.
Nothing in this release limits liability for gross negligence (culpa grave), willful misconduct (dolo), or non-waivable rights under Colombian consumer law (Ley 1480/2011). Colombici’s duty in emergencies is limited to reasonable efforts to arrange care and evacuation, not to guarantee outcomes or response times, particularly in remote areas. The presence of a support vehicle, guide, or mechanic does not eliminate the inherent risks of cycling.
4. INDEMNIFICATION
The Participant agrees to indemnify and hold harmless Colombici from any claims, damages, losses, or expenses, including legal fees, arising from their participation or actions during the journey.
5. MEDICAL AUTHORIZATION AND INSURANCE
In the event of injury, illness, or emergency, the Participant authorizes Colombici to arrange medical care and evacuation on their behalf. The Participant accepts full financial responsibility for all medical, transportation, and evacuation costs.
Colombici does not provide medical insurance. Comprehensive travel and medical insurance covering cycling accidents, medical evacuation, and repatriation is required for participation.
6. DATA PROTECTION (HABEAS DATA, LEY 1581/2012)

Operational data. The Participant consents to the collection and processing of personal, contact, medical, and insurance data for the sole purpose of managing the journey, ensuring safety, and complying with legal obligations. Medical information is treated as confidential and destroyed within ninety days of journey completion. Other operational data is retained only as required by law.
Image and media consent. The Participant may separately consent to the use of photographs, video, and other media captured during the journey for editorial, marketing, and archival purposes. This consent is optional, revocable at any time in writing to hola@colombici.cc, and does not affect participation.
7. GOVERNING LAW, JURISDICTION, AND LANGUAGE
This agreement is governed by the laws of the Republic of Colombia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bogotá DC. This agreement is provided in English and Spanish. In case of conflict between versions, the Spanish version shall prevail.
8. ELECTRONIC SIGNATURE
The Participant agrees that an electronic signature carries the same legal effect as a handwritten signature under Ley 527/1999.
9. SEVERABILITY
If any provision of this agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10. ACKNOWLEDGMENT
By signing, the Participant confirms that they have read, understood, and agree to this agreement voluntarily, and that it constitutes a complete and unconditional release of liability to the fullest extent permitted by law.

COLOMBICI EXONERACIÓN DE RESPONSABILIDAD, ASUNCIÓN DE RIESGO Y LIBERACIÓN
Este acuerdo se celebra entre Colombici SAS (NIT 901733291-0), Carrera 21 #101-33 Apto 601, Bogotá DC, Colombia (“Colombici”), y el participante abajo firmante (“Participante”).
1. ASUNCIÓN DE RIESGO
Pedalear en Colombia es gratificante. También implica riesgos reales e inherentes. La participación en los viajes de Colombici incluye, entre otros:
- Circular por vías abiertas junto a vehículos motorizados, peatones, ciclistas y animales
- Superficies variables, incluidas vías pavimentadas y destapadas, grava, baches y escombros
- Fallas mecánicas de bicicletas o equipo, propio o de alquiler
- Condiciones climáticas incluyendo calor, lluvia, viento, rayos y frío
- Enfermedades relacionadas con la altitud, incluyendo hipoxia y edema pulmonar
- Esfuerzo físico que puede causar agotamiento, deshidratación, eventos cardíacos o lesiones
- Desplazamiento en zonas remotas o rurales donde la atención médica y la evacuación pueden demorarse
- Exposición a enfermedades transmisibles incluyendo COVID-19 y dengue
- Actos, errores u omisiones de proveedores externos de alojamiento, transporte y alimentación
El Participante asume voluntariamente todos los riesgos, conocidos o desconocidos, incluidos los derivados de negligencia ordinaria.
2. DECLARACIONES DEL PARTICIPANTE
Al firmar, el Participante confirma que:
- Es mayor de 18 años. Los menores solo podrán participar con aprobación previa por escrito y liberación firmada por padre o tutor.
- Se encuentra en condiciones físicas y mentales para participar en un viaje ciclístico de varios días en altitud.
- Ha completado con exactitud la divulgación médica confidencial entregada en el momento de la reserva y ha declarado toda la información médica, alimentaria y de seguridad relevante.
- Es un ciclista de ruta experimentado que ha pedaleado regularmente en vías abiertas durante los doce meses previos al viaje.
- Su equipo personal es seguro, adecuado y está en condiciones mecánicas óptimas. Quienes usen equipo de alquiler confirman haberlo inspeccionado y aceptarlo en su estado actual.
- Cumplirá con la Ley 769/2002, las instrucciones de los guías y la prohibición de consumo de alcohol o sustancias psicoactivas mientras pedalea.
- Usará casco en todo momento sobre la bicicleta.
La declaración falsa sobre condición física, experiencia o estado de salud faculta a Colombici para retirar al Participante del viaje sin reembolso y lo libera de cualquier reclamo relacionado.
3. EXONERACIÓN DE RESPONSABILIDAD
En la máxima medida permitida por la ley colombiana, el Participante exonera y libera a Colombici SAS, sus directores, empleados, contratistas, guías, socios, patrocinadores y representantes de toda responsabilidad, reclamo o demanda derivada de la participación en los viajes de Colombici, incluyendo lesiones, enfermedad, pérdida de bienes o muerte, ya sea por negligencia ordinaria u otra causa.
Nada en esta liberación limita la responsabilidad por culpa grave, dolo, o derechos no renunciables bajo la Ley 1480/2011. El deber de Colombici en emergencias se limita a esfuerzos razonables para coordinar atención y evacuación, sin garantizar resultados ni tiempos de respuesta, en especial en zonas remotas. La presencia de vehículo de apoyo, guía o mecánico no elimina los riesgos inherentes al ciclismo.
4. INDEMNIZACIÓN
El Participante acepta indemnizar y mantener indemne a Colombici de cualquier reclamo, daño, pérdida o gasto, incluidos honorarios legales, derivados de su participación o de sus actos durante el viaje.
5. AUTORIZACIÓN MÉDICA Y SEGURO
En caso de lesión, enfermedad o emergencia, el Participante autoriza a Colombici a coordinar atención médica y evacuación en su nombre. El Participante acepta la responsabilidad financiera total por todos los costos médicos, de transporte y evacuación.
Colombici no provee seguro médico. Es obligatorio contar con seguro integral de viaje y médico que cubra accidentes ciclísticos, evacuación médica y repatriación.
6. PROTECCIÓN DE DATOS (HÁBEAS DATA, LEY 1581/2012)

Datos operativos. El Participante consiente el tratamiento de sus datos personales, de contacto, médicos y de seguro con el único fin de gestionar el viaje, garantizar la seguridad y cumplir obligaciones legales. La información médica es confidencial y se destruye dentro de los noventa días posteriores a la finalización del viaje. Los demás datos operativos se conservan solo por el tiempo requerido por ley.
Consentimiento de imagen. El Participante puede otorgar, de manera separada, su consentimiento para el uso de fotografías, video y otros medios capturados durante el viaje con fines editoriales, de marketing y de archivo. Este consentimiento es opcional, revocable en cualquier momento por escrito a hola@colombici.cc y no afecta la participación.
7. LEY APLICABLE, JURISDICCIÓN E IDIOMA
Este acuerdo se rige por las leyes de la República de Colombia. Cualquier disputa estará sujeta a la jurisdicción exclusiva de los tribunales de Bogotá DC. Este documento se entrega en inglés y español. En caso de conflicto entre versiones, prevalecerá la versión en español.
8. FIRMA ELECTRÓNICA
El Participante acepta que una firma electrónica tiene el mismo efecto legal que una firma manuscrita bajo la Ley 527/1999.
9. DIVISIBILIDAD
Si alguna disposición de este acuerdo se considera inválida o inaplicable, las demás disposiciones continuarán en pleno vigor.
10. RECONOCIMIENTO
Al firmar, el Participante confirma que ha leído, entendido y aceptado este acuerdo de manera voluntaria, y que constituye una liberación completa e incondicional de responsabilidad en la máxima medida permitida por la ley.
